Maryland Law Summary
Maryland
Insurance Requirements
Maryland requires that all drivers carry a minimum bodily injury coverage of $20,000 per individual and $40,000 per accident. Drivers are required to carry $15,000 property damage coverage per accident. In addition, Maryland requires that you have uninsured motorist coverage and PIP coverage unless you sign a waiver.
Contributory vs. Comparative Negligence
Maryland is a pure contributory negligence state. This makes it more crucial that you employ an experienced auto accident lawyer who can prove that you did not contribute to your accident in any way.
Statute of Limitations
In Maryland, you have three years from the date of your accident to file your personal injury claim.
Joint and Several Liability
Maryland follows a system of joint and several liability.
Seatbelt and Helmet Laws
Maryland requires that all drivers and passengers in the front seat aged 16 or older wear their seat belts at all time. However, the failure to wear a seatbelt cannot be used to prevent you recovering from your injuries.
